BOARDING AGREEMENT FOR NORTH STAR RIDING CENTER LLC

THIS AGREEMENT, for good and valuable consideration receipt of which is hereby acknowledged, dated the:

Made by and between North Star Riding Center LLC, hereinafter referred to as "STABLE", providing services as an independent contractor, located at 41738 Cleveland Rd, Tyndall,  SD 57066 and:

hereinafter referred to as "OWNER”. These parties warrant that they have the right to enter into this AGREEMENT.

FEES, TERMS AND LOCATION

In consideration of $300 per horse per month paid by OWNER in advance on or before the Fifth day of each month, North Star Riding Center LLC agrees to board the herein described horse (s) on a month-to-month basis starting this:

Partial months boarding shall be paid on a pro-rata basis based on the 

numbers of days boarded in a standard 30-day month.

Late Fees: Boarding Fees received after the 5th will be subject to a late fee of $25.00.

DESCRIPTION OF HORSE(S)

FEED AND FACILITIES

North Star Riding Center LLC agrees to provide the following, in addition to normal and reasonable care and handling to maintain the health and well being of the horse. 

*Use of all NSRC facilities; indoor and outdoor arenas, X-Country course; tack up areas, tack locker and wash rack

*Adequate quality and quantity of grass hay

*Grain (pelleted Yaggies Horse Feed) one time a day (additional supplements are the responsibility of the owner to provide)

*Access to shelter

VACCINATIONS

Upon arrival of horse to North Star Riding Center LLC proof of current tetanus, sleeping sickness (East and West), influenza, West Nile Virus, and Rabies vaccinations is required. Proof of all vaccines is required each year in the spring as recommended by the American Association of Equine Practitioners. Rhino/Influenza vaccine are given every three months and will be the expense of the OWNER.   

Owner is required to maintain a De-Worming schedule. 

A negative current Coggins test is required for all horses. 

RISK OF LOSS

During the time that the horse is in the custody of North Star Riding Center LLC, North Star Riding Center LLC shall not be liable for any sickness, disease, theft, death or injury which may be suffered by the horse. This includes, but is not limited to, any personal injury or disability the horse may receive while of North Star Riding Center LLC’s premises. OWNER fully understands and hereby acknowledges that North Star Riding Center LLC does not carry any insurance on any horse not owned by North Star Riding Center LLC, including, but not limited to, such insurance for boarding or any other purposes, for which the horse is covered under any public liability, accidental injury, theft or equine mortality insurance, and that all risks relating to boarding of horse, or for any other reason, for which the horse is in the possession of North Star Riding Center LLC, are to be borne by OWNER. 

HOLD HARMLESS

OWNER agrees to hold North Star Riding Center LLC harmless from any claim resulting from damage or injury caused by said horse, OWNER or his guests and invitees, to anyone, including but not limited to legal fees and/or expenses incurred by North Star Riding Center LLC in defense of such claims AND AGREE NOT TO SUE NORTH STAR RIDING CENTER LLC OR ANY OF ITS ASSOCIATES.

EMERGENCY CARE

North Star Riding Center LLC agrees to attempt to contact OWNER, at the following

Should North Star Riding Center LLC feel that medical treatment is needed for said horse, provided however, that in the event the North Star Riding Center LLC is unable to so contact OWNER within a reasonable time, which time shall be judged and determined solely by North Star Riding Center LLC, North Star Riding Center LLC is then hereby authorized to secure emergency veterinary care and/or blacksmith care, and by any licensed providers of such care who are selected by North Star Riding Center LLC, as North Star Riding Center LLC determines is required for the health and well-being of said horse. The cost of such care secured shall be due and payable by OWNER within fifteen days from the date OWNER receives notice thereof, provided however, that North Star Riding Center LLC is authorized to arrange direct billing by said care provider to the OWNER.

NORTH STAR RIDING CENTER LLC RULES

Owner hereby acknowledges receipt and understanding of the current North Star Riding Center LLC Rules, which are incorporated by reference in full, as if fully set forth herein. OWNER agrees he/she and his/her guests and invitees will be bound and abide by these Rules and accepts responsibility for the conduct of his guests and invitees according to these Rules. OWNER acknowledges the Rules include but are not limited to:

*Respectful treatment of others

*Clean up after yourself and your horse

*10 pm night curfew

*Shut off all lights when exiting any rooms, arena, barn etc

North Star Riding Center LLC may revise these Rules from time to time and OWNER agrees any revision shall have the same force and effect as current Rules. Failure, as determined in North Star Riding Center LLC’s sole discretion, of OWNER or OWNER’s guests and invitees to abide by North Star Riding Center LLC Rules may result in North Star Riding Center LLC declaring OWNER in default hereunder and result in termination of this AGREEMENT. 

DEFAULT

Either party may terminate this AGREEMENT for failure of the other party to meet any material terms of this AGREEMENT. In the case of a default by one party, the other party shall have the right to recover legal fees and expenses, if any, incurred as a result of said default. Any payment due North Star Riding Center LLC under this AGREEMENT shall be due and payable by the tenth day of the month and immediately in the event of termination. Failure to make any payment by said due date shall place OWNER in default hereunder. Acceptance by North Star Riding Center LLC of any late payment shall not constitute a waiver of subsequent due dates or determinations of default. 

ASSIGNMENT

This AGREEMENT may not be assigned by OWNER without the express written consent of North Star Riding Center LLC. 

PHOTOGRAPHY/ADVERTISING

North Star Riding may, on occasion, take video or photographs of boarded horses or such horses may be in the background of videos or photos.  Such video and/or photography may be used to help promote North Star Riding through various forms of communication including but not limited to: social media, website, e-newsletters and print, or otherwise communicate to families about the experiences or accomplishments of North Star Riding participants.  North Star Riding will not use names without further written permission.  By initialing you are consenting to North Star Riding’s use of photos or videos for purposes of North Star Riding communications and promotions.  No compensation will be provided for such use unless separately agreed to, in writing, with North Star Riding LLC.

NOTICE OF TERMINATION

OWNER agrees that at least thirty (30) days notice shall be given to STABLE prior to the termination of this AGREEMENT.

RIGHT OF LIEN

OWNER is put on notice that North Star Riding Center LLC has and may assert and exercise a right of lien, as provided for by the laws of the State of South Dakota for any amount due for the board and keep of horse, and also for any storage or other charges due hereunder, and further agrees North Star Riding Center LLC shall have the right, without process of law, to attach a lien to your horse after three (3) months of non-payment or partial payment and North Star Riding Center LLC can then sell horse to recover its loss.

GOVERNING LAW

THIS AGREEMENT IS SUBJECT TO THE LAWS OF THE State of South Dakota.
